TERMS AND CONDITIONS OF POČITEK- UŽITEK D.O.O. (TERME VIVAT)

1. PRICES

The prices are apply for the current year. The prices are in EUR and include VAT. Terme Vivat (Počitek-Užitek d.o.o.) reserves the right to change prices.

2. BOOKINGS

2.1 ACCOMMODATION BOOKING

The accommodation and service capacities can be booked on the Pool&Wellness reception, via phone, fax or email. The guest receives a booking confirmation via email or regular mail. The confirmed offer can change until the day of arrival.

2.2 SERVICE BOOKINGS IN THE WELLNESS&MEDICAL CENTRE VIVAT AND IN THE THAI MASSAGE SALON

The services in the Wellness&medical centre and the Thai massage centre can be booked via phone or email. It is desired that the services in the Wellness&medical centre Vivat and the Thai massage salon are booked in advance, namely at least three days before the arrival.

3. BOOKING AND SERVICE CANCELLATION

3.1 CANCELLATIONS MADE BY INDIVIDUAL GUESTS

The guest has the right to cancel her/his bookings. The cancellation must be done in writing and sent via email at least 5 days before the day of arrival. Based on the date of the sent cancellation the cancellation costs will be calculated.

  • In case of a timely cancellation, the guest has the right to be refunded the full advance or the full payment of the accommodation
  • In case of a cancellation 4 days before the arrival, the guest will be charged a cancellation fee in the amount of 30 % of the booking
  • In case of a cancellation 2 days before the arrival, the guest will be charged a cancellation fee in the amount of 50 % of the booking
  • In case of a cancellation on the day of arrival or in case of a no-show, the guest will be charged a cancellation fee in the amount of 100 % of the booking without tourist tax
  • In case of an early departure the hotel reserves the right to charge a fine in the amount of 100 % of the amount of the remaining stay without tourist tax. Exceptions are departures due to force majeure (death, medical reasons, natural catastrophes ...)
  • The cancellation costs will be calculated based on the prices that were confirmed upon booking.

3.2. CANCELLATION OF GROUP ACCOMMODATION

A group consists of 10 or more persons whose accommodation is organised by the organiser. The organiser has the right to cancel the booking. The cancellation must be done in writing and sent via email at least 45 days before the arrival of the group. Based on the date of the sent cancellation the cancellation costs will be calculated.

  • In case of a timely cancellation, the organiser will not be charged any cancellation fee
  • In case of a cancellation 44 to 30 days before the arrival, the organiser will be charged a cancellation fee in the amount of 50 % of the booking
  • In case of a cancellation 29 to 15 days before the arrival, the organiser will be charged a cancellation fee in the amount of 30 % of the booking
  • In case of a cancellation 15 to 1 day before the arrival, the organiser will be charged a cancellation fee in the amount of 80 % of the booking
  • In case of a cancellation on the day of arrival or in case of a no-show, the organiser will be charged a cancellation fee in the amount of 100 % of the booking without tourist tax
  • In case of an early departure the hotel reserves the right to charge a fine in the amount of 100 % of the amount of the remaining stay without tourist tax. Exceptions are departures due to force majeure (death, medical reasons, natural catastrophes ...)

3.3 CANCELLATION OF SERVICES IN THE WELLNESS&MEDICAL CENTRE AND THE THAI MASSAGE CENTRE

The requested service can be cancelled up to 24 hours before the booked appointment. When cancelling the service less than 24 hours before the booked appointment you will be charged 50 % of the price of the booked service. For cancellations less than 4 hours before the booked appointment you will be charged 100 % of the price of the booked service. In case the booked service is not cancelled and not will not be used, we will charge you 100 % of the price of the booked service. 

4. PAYMENT

pon arrival at the hotel, we kindly ask you to guarantee your stay with a credit card. An authorization will be made for the cost of the reserved service and any anticipated additional charges during your stay. Please present the credit card used for the reservation upon check-in.

If you do not have a credit card, the full amount of your stay must be paid in advance upon arrival at the hotel.

If you use additional services during your stay and wish to charge them to your room, an additional deposit will be required at check-in.

Upon check-out, all accommodation and additional costs must be settled in full. If the final cost of your stay does not exceed the authorized or prepaid deposit, the unused amount will be released. However, we cannot influence the time it takes for your bank to process the release of funds.

Payment for services can be made at the reception of Hotel Vivat in cash or with credit/payment cards (BA, Maestro, Diners, Visa, Eurocard, Activa).

5. TOURIST TAX EXEMPTION

If you are exempt from paying the tourist tax, you must notify the reception upon arrival. If not, you will be have to pay for the tourist tax.

6. STRESS-FREE PARKING AND MOBILITY

Use of the Parking Area: The covered and secured parking area is exclusively for hotel guests. The hotel assumes no responsibility for any damage to or theft of vehicles and personal belongings left inside them.

Valet Parking: A valet parking service is available at the hotel reception upon check-in. Guests are responsible for properly securing their vehicles (locking the doors, turning off the engine) before handing them over to hotel staff. The hotel does not assume responsibility for personal belongings left in the vehicle.

Electric Charging Stations: Charging stations for electric cars and e-bikes are available for hotel guests. Usage is subject to applicable pricing and availability of charging points. The hotel is not responsible for any technical malfunctions or downtime of the charging stations.

Secured Bicycle Storage: The bicycle storage area is intended for the safe keeping of personal or rented bicycles. Guests are required to properly lock their bicycles. The hotel assumes no responsibility for any damage to or theft of bicycles and equipment.

7. CHECK-IN

You can check-into your room after 2 p.m.. In case of full occupancy, the hotel reserves the right to change the check-in time. On the day of departure, the rooms are available for the guest until 10 a.m..

If the guest has not left the room by 10 a.m., a fee for late departure will be charged according the latest price list.

8. STORAGE OF VALUABLES AND PERSONAL THINGS

You can store your money and valuables in the safe in your room. The hotel does not assume any responsibility for things that are stored in the safes. Furthermore, the hotel does not assume any responsibility for things that are stored in the hotel rooms and other areas.

9. PETS

Pets are not allowed to be held in the rooms of the Hotel Vivat***** and the common spaces of the Terme Vivat. In case we find out that there you have a pet in a room where it is not allowed to hold one, you will be charged for a general cleaning of the room based on the regular pricelist.

10. SMOKING

Smoking is not allowed in the rooms and other closed spaces of the Hotel Vivat*****. In case of smoking in the room or in the closed spaces, a fee for smoking in the room, and the cost of general room cleaning will be charged based on the regular pricelist.There is a smoking room next to the swimming pool reception, and it is allowed to smoke on the terrace of the Hotel Vivat.

11. MAIN RESTAURANT VIVAT

Breakfast every day from 7:00-10:00, lunch from 12:00-14:00, dinner from 18:00-20:30.

The meals in the restaurant are usually in form of a self-service buffet, unless there are less than 36 meals, then they will be served.

12. A LA CARTE RESTAURANT VITA

Open daily from 14:00 until 18:00.

13. DRESS CODE FOR THE MAIN RESTAURANT VIVAT AND THE A LA CARTE RESTAURANT VITA

During your meals in the main restaurant Vivat and the A la Carte restaurant Vita the guests must wear appropriate clothes (long trousers and closed shoes-man). For dinner, evening wear is desired.

14. EXCHANGING MEALS

Exchanging a meal (dinner for lunch or vice versa) is only possible upon further notice, at the reception of the Hotel Vivat.

15. SWIMMING POOL COMPLEX OF THE TERME VIVAT

From October to May, it is open daily from 8:00 AM to 7:00 PM, and from June to September, it is open daily from 8:00 AM to 8:00 PM.

In the pool complex, guests have free access to padded sun loungers, a small table, and umbrellas. Reserving sun loungers is not allowed. Entry to the pool complex is permitted in all swimwear except burkinis.

Guests of the Terme Vivat pool complex must use the facilities in accordance with the pool regulations.

16. WORLD OF SAUNAS VIVAT

Open daily from 12:00 PM to 7:00 PM. The Vivat Sauna World is closed from June to August.

Guests of the Vivat Sauna World must use the facilities in accordance with the pool regulations.

17. WELLNESS & MEDICAL CENTRE

Open daily from 9:00 AM to 6:00 PM. Services at the Vivat Wellness & Spa Center can be booked at the pool & wellness reception, by phone, or via email.

18. THAI MASSAGE PARLOUR

Open daily from 9:00 AM to 6:00 PM. Services at the Thai Massage Salon can be booked at the pool & wellness reception, by phone, or via email.

19. TOWELS

You will find a set of towels per person in your bathroom. Every day tons of towels are being washed in hotels all over the world and tons of detergents are being used which are polluting our environment. The decision is in your hands. A towel on the floor means: Please exchange. A towel hanging up means: I will use it again. At the guests' request, towel changes are also possible during the evening room cleaning. It is not allowed to take out towels and other things from the hotel rooms. The towels in the room are electronically secured and are not intended to be used in the swimming pool complex, but should be used in the hotel room only. Towels have to be in your room at 10 o’clock on the day of your departure. Else you will be charged for them.

20. BATHROBES

Bathrobes can be found in the clothes cabinet of your room. The use of bathrobes after 10 a.m. on the day of your departure is not allowed. The bathrobes have to stay in your room on the day of your departure. Else you will be charged for them in accordance with the applicable pricelist.

21. BATH TOWELS

Upon check-in, you will receive 1 bath towel card per person with which you can pick up your bath towels at the pool reception. You can change your used bath towel every day for a new bath towel. When you check out of the hotel, you must hand in your bath towel card at the main reception, which will indicate that you have returned the bath towels at the pool reception.

The towels in the room are not meant to be used in the swimming pool complex. They are intended to be used in the hotel room only.

22. ANNUAL CLEANING AND MAINTENANCE OF THE SWIMMING POOLS

The annual cleaning and maintenance of the swimming pools are done according to the annual plan of the swimming pool complex of the Terme Vivat (Počitek-Užitek d.o.o.) and published on the website each year.

23. USE OF THE ROOMS

The overnight stay of persons who are not registered is forbidden and will be billed according to the regular pricelist.

You are not allowed to bring your own food and drinks to the hotel rooms. There is a varied offer waiting for you in the hotel restaurants, and you can also always use our room service.

You are not allowed to store food and drinks in the mini bar in your room. The mini bar is intended for the products listed on the mini bar pricelist only.

The room is equipped with a kettle and offers coffee and tea, which guests can use free of charge.

24. DAMAGE TO THE ROOM OR THE INVENTORY

The guest must take care of the rooms, the equipment, the inventory and the devices that are available to him. The guest assumes responsibility for the damage in the room, on the equipment, the inventory and the devices which are caused by him. It is also not allowed to take inventory from the rooms or the common spaces of the Terme Vivat. In case of damages, the appropriate amount will be withdrawn from your credit/bank card.

25. GIFT CARDS

Gift cards for accommodation, wellness&medical centre and the Thai massage salon, can be used until the date written on the gift card. Gift cards can not be redeemed for cash. 

26. TICKETS FOR THE SWIMMING POOL COMPLEX

The tickets for the swimming pools are valid until the validity date stated on them.

27. EVENTS IN THE HOTEL

On different occasions during the whole year weddings, parties and other events that could disturb your stay are being held in our restaurants. We kindly ask you to inform yourself about these events before booking your stay.

28. COMPLAINTS

A guest can submit a written complaint at the reception of Hotel Vivat*****, to which the management of Terme Vivat will respond in writing as soon as possible, but no later than 8 days from the receipt of the complaint. To ensure a faster and more efficient handling of the complaint, the guest must clearly state their contact details, reservation number or room number, and a detailed description of the issue or deficiency in the service.

The guest can also submit the complaint by filling out a form available at the hotel reception.

In the case of a justified complaint, Hotel Vivat***** will take all necessary steps to resolve the issue as soon as possible or offer the guest an appropriate alternative service or other form of compensation, in accordance with the hotel's internal policies. Complaints submitted after the guest’s departure from the hotel and without prior notification to the staff during the stay will be handled in accordance with the general terms and conditions, taking into account whether the issue could have been objectively resolved during the guest's stay.

29. INVOICES

Upon departure (check-out) you will receive an invoice for your accommodation and any other services. If you wish to have your invoice issued for a company, you have to pay at the reception and the invoice will be issued for the company you wish. We kindly ask you to inform us in advance.

30. PROTECTION OF PERSONAL DATA

Protecting the privacy of visitors to Terme Vivat
The company Počitek-užitek d.o.o., Ulica ob igrišču 3, 9226 Moravske Toplice (hereinafter referred to as data manager), will carefully protect personal data received by e-mail, telephone, information and booking forms, as well as online e-news registration or website in accordance with the Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and on the traffic of such data, and in accordance with the rest of the Slovenian and European legislation (hereinafter referred to as The General Data Protection Regulation (GDPR)). As a result, the company undertakes not to transfer data to third parties or companies for the purpose of commercial use of personal data.

Approval
The visitor of Terme Vivat voluntarily provides his/her personal data and authorizes Počitek-užitek d.o.o. to collect, use, process and store his/her personal data. The personal information that you provide to us when booking is required in accordance with the legitimate business of the company for processing your order, for direct marketing purposes and for communicating on certain matters.

It is assumed that by accepting the offer and passing personal information by e-mail or by sharing the personal data by telephone or website www.vivat.si, the visitor agrees that the company Počitek-užitek d.o.o. under the brand Terme Vivat uses this information solely for internal statistics and data processing in the course of its legitimate business activities, namely for booking confirmations, communication with customers, marketing, direct marketing, information on offers and novelties, and the sending of e-news. If a visitor does not want this, he/she can declare this at any time.

Your rights
The company Počitek-užitek d.o.o. allows anyone who has entrusted their personal information to to them to request at any time by e-mail or otherwise that Terme Vivat discontinues his/her personal information or any part of their personal information for direct marketing, offers or other processing. The personal information of the visitor can be kept by the company for an unlimited time and until the revocation of the use of the personal information. Every visitor of Terme Vivat has the right to access, copy, overwrite, update, correct, block and delete his/her personal data.
